I explained the circumstances to Mr. Kilburn, who was obliged to leave it for adjustment by his successor, but I have further to observe that it was customary in making arrangements with Chinese Contractors for such works as the track, and upon which I had no skilled or trustworthy person to act as treasurer, to require deposit, the principal for the maintenance of the work for a certain reason. ... considerable damage to the Military Hospital without hesitation. The Contractor proceeded to rectify the damage to the Hospital and rebuilt the granite wall almost from the foundation. The excessive charge made for this work was included in his claim of the splintered granite in '63. He conducted himself for losses presumed. The boulder stone breach for which payment amounting to $469.80 was on the site, the formation and finish were of a massive and only portion disjointed, the arch in the cliff and supported a boulder which cropped out from its face. This was carried away by the Landslip, which rendered the execution of the Granite Wall necessary.
I conclude that the Wall as now erected has been finished in a perfectly substantial manner and to my satisfaction. I consider the contractor's claim for the supply of hard woods - in lieu of sustaining just and reasonable, no doubt he received instructions to furnish the hard wood and executed the final order deficient.
