April 27th To The Defendant having left for Europe at- tending Mr. Owen when he asked me

for my personas security for the Defen- dant on the ground that my representa- tions were the sole cause of his suspend- ing the proceedings for arrest; that my notes amounted to a promise to give se- curity and that the hour of the night when I informed him of the failure of my attempt was too late for him to do any thing as it was Saturday night and even if he had the Judge's order ready no ar- rest could be made after 12 o'clock....... Attending Mr. Owen when I informed him that my promise was conditional on Mr. Cahill's joining as Bail and on the De- fendant give us an indemnity and that I could not give my security to the very heavy amount required in this action but that if through my interference on Saturday he himself should ultimately proved to have sustained any loss I would bear half of it-as I felt that I was the means of losing him his advan- tage though I was most innocently mis- led and had acted myself in good faith, Drawing appearance copy for entry and
