Money borrowed
X.-All and singular, to be a preferable debt on the Colonial Revenues, &c.
All and every sum or sums of money borrowed or raised under and by virtue of this Ordinance, together with such interest as may from time to time accrue thereon, shall be, and the same are hereby, charged upon the General Revenues and Assets of the Colony preferably to any other charges whatever thereupon.
In case of deficit to be raised.
XI.-In case there shall be any deficit in the General Revenues of the Colony, to meet the aforesaid payments, or to meet any part of the cost of the Fixed Establishment or Services that may have been prejudiced or displaced thereby, such deficit shall be provided for by the imposition of such Taxes or Duties as the Legislature for the time being shall deem proper.
XII.-The money borrowed to be applied only to Railway undertaking.
The money borrowed under the authority of this Ordinance, shall be applied exclusively in and about the construction of the Railways described in the preamble of this Ordinance, and in the payment of other costs and expenses hereinbefore provided.
But the lenders of the said money shall have no right, title, or interest to inquire into or insist upon, the application of the said money as aforesaid; nor shall their rights or interests be prejudiced or affected by any mis-application of the said money.
XIII.-This Ordinance shall come into operation on the third day of May 1862.
