of Heer

port of place not being

or Majesty's possessions abroad, then in judgment the "Ardville" was not a Passenger ship within the

provisions of the Passenger Act 1835, and the Government of Hong Kong had no right to recover from the registered owner of the "Ardville" the sum paid for the conveyance of the shipwrecked passengers to Hong Kong,

nor was it

competent for Williamson, the master of

the "Ardville" to make

any

Contract on

behalf of his owner to pay for such

passenger

services which would be binding on him. Consequently, the "Ardville" was not a ship within the meaning of the Act referred to, no action to recover the £104.3.4 can be successfully maintained against the Owner W.W. Kitto.

Mention is made in the

correspondence

of some Bill upon the

Owner; if such Bill was drawn by Williamson, or the Government of Hong Kong made the advance to Williamson upon his credit,

and they are able to prove it, then he is the person who is responsible for, and may be made to pay that sum.
