Before answering M. Kitto's question upon which his legal obligation has arisen, I thought it right (as suggested in your letter of 12th June 1867) to consult the Emigration Commissioners, and I inclose for the Governor's consideration a copy of their letter on the subject, from which it will be seen that in their opinion no steps can be taken under the Passengers Act for Enforcing the repayment by Kitto of the money advanced by the Sovereign of Hong Kong to him.
The Crown Agents do not expect to be able to compel W. Hills to reimburse the amount claimed by the Land Board and would be glad, before taking further steps in the matter, to receive further instructions from His Excellency on the subject.
