This Ordinance is substantially the same as that enfolded by Mr Bourke and transmitted in your Grace's Despatch N. 98 of 26th July, 1868.

The amendments adopted by the Legislative Council were suggested by the Acting Chief Justice Mr. Braddell, who kindly undertook the revision of the draft in consequence of the illness of the Attorney General. The alterations made do not affect any material principle as will be seen from N. 2. and N. 3. the accompanying epitome of them drawn up by Mr. Ball, the object of the Council being merely to adapt the principle of the Ordinance, so ably framed, to the condition of things existing in this Colony, not to introduce any new principle.

4. The measure is one in my judgment admirably calculated to meet the requirements of this Community.
