The plea that it was Meant for Military purposes is no longer valid.
In consequence, I am not aware of any legal means by which the Military Department could give a title to such land, as although in the possession of the Military it still forms a portion of the Crown Lands of the Colony.
And the Charter prescribes the Mode of disposing of Crown lands - namely under the hand of the Governor and the Great seal of the Colony.
In cases where the selling value of land surrendered by the War Department has been increased by expenditure on Imperial buildings reclaiming some of the Sea, or other permanent improvements
