Conferred several times with the first-Shroff and his legal adviser and if there had been even a remote hope of success and if they would have proceeded with the case relying on the accidents which frequently arise in such cases. My recollection entirely agrees with your own that the first shroff was alone proceeded against because the Committee of Inquiry reported that the money was solely in his custody as he frankly admitted, and that he was in fact much to his credit, in such precaution on the occasion. He omitted his usual practice at the closing of the day in question.
I had no doubt that the 2nd Shroff was also at fault as fact stated the money, I was informed if I recollect rightly that an attempt was made to charge the 2nd Shroff criminally, and I took great pains to fix the case civilly on his securities and I do not doubt that this is one of the cases, in which crime has escaped punishment or discovery.
