giving effect to
the
Ordinance I think
it extremely desirable
that the Prison Regulations should
in fact be made not
by a varying body of three magistrates
whose proceedings may
be guided by no settled
principles, but by
the Governor in Council
acting (if necessary) on
the information & advice
furnished by those Magistrates.
The regulations,
in my opinion, should provide that every
Case of
flogging
should
be unfailingly recorded together with the Cause of Punishment
and its amount,
and it would be
desirable by
such
regulations, to limit the arbitrary power
which is given by the 12 clause of the Ord. of inflicting 36 lashes
