harbour, communicated with persons in this Colony and that the Vessel received by China boats ordinary stores and some couts and that the United States Consul although he was officially aware of the proclamation of the 26th of March 1824, has made no communication to this Government as to these occurrences.

I have carefully considered the five questions which have been submitted to me in your letter and I proceed to answer them explicitly as follows:

1. I am of opinion that the "Wyoming" being, as it is stated to be, outside the actual Boundary of the Harbour, is to be considered beyond the jurisdiction of the Colony, although she is lying within a league of our coasts.

2. The fact that she lies nearer the Chinese shore than our own is in fact the reason why she is beyond the jurisdiction of this Colony, and therefore of the Crown of England.

3. I am of opinion that neither the landing and taking off of some of her crew in the Harbour of Hongkong nor the obtaining of supplies by Lorchas or other Chinese Vessels constitutes such a communication with Victoria or such a reception of supplies therefrom as brings her, with reference to her place of anchorage being out of the jurisdiction of this Colony, within the scope of the Proclamation of the 26th
