that he was at first placed in the Criminal dock with him, and afterwards, when the trial was over, was the person to whom the books of account of the hang were handled, at Caldwell's instance, by Mr. Grandpre, Asistant Superintendent of Polies, and, if Shum Ahing's statement frue, were then by him given to Mr. Caldwell's wife.

Determined on getting this man but of the way, this, according to what was fint in the volume of minutes, and what may reasonably bu inferred, was the manier of his proceeding.

From Kapchee, on the East Coast of China, Chinese are in the habit of emigrating in bodies to the Straits of Malacca, to Manila, and other parts of the world; and a part of the business of the hong, of which Shum Aling bad the management, was the arrangment of labour contrac's for men passing though the Colonial waters.

In Decumbur, 1859, a bout arrival in Hongkong from Kupchice with 120 men, intended, it was asserted, for labour in the Straits. At that particular period of time the public mind was agitated with stories of Then being kidnapped for the Havana market, and, consequent on infor mation given to the police that the men in question hal been kidnapped d were intenlet for Havana, the whole of them were released and sent adrift in the Colony.

Subsequent circumstances lead to the belief that the information on which the police acted in this case was prompted by Caldwell, the first step in a scheme to procure the conviction of Shum Aling for Kidnapping, and the consequent doing away of his ability to give evidence of the piratical intimacy between him and Mah-chow Wong,

The men being at liberty to go where they pleased, went with their head men to Shun Ahing's hong, where they remained till the 3th of December, when, as will have been foreseen by the schemer, some of them went to Macao to procure engagements, Shum Abing going with them to receive payment for the expense he had been at in supporting them. Up to this point Caldwell's connection with the matter is hypothetical only; the hypothesis being supported by the following.

1. That the 120 Coolees came from the place to which Caldwell afterwards went for Sze-lo-yae, Mal-ehow Wong's friend and partner in business.

2. That coming from this place, Caldwell know that when released the men would go to Shum Ahing's hong,

3.—The intimacy between Mali-chow Wong wife's brother and Asoong one of the 120, by whose instrumentality Shum Aling was afterwards convicted.

And 4th, that only by these mon getting in debt to Shun Abing for board, could it be likely that he would have the handling of any of the money which these men might obtain by contracting to go to

Ilavana-contracting which, by the construction placed on it by the Hongkong Courts, amounts to selling into slavery.

On reaching Macao an endeavour was made by Shum Ahing to proeuro engagements for the men to go to the Straits as they originally intended. But it was not possible to procure advances, and then ten of the 45 that weat to Macan consented to go to Havana, and out of their advances pay off the debt due by all, (for this, no doubt, reueiving prospective co sideration for their families)-Asoong on; of the 45 acting as broker for them, and receiving $72 of the sum of $275, given at the rate of 27 to euch; the rest of the money is 2024, going to Shua Abing in liquit ation of his bill for board of the whole 120 that had been in his hong, and for repayment of alvance for hire of a bout to taku 75 of the original 120 back to Kupekee. That Shmu Aling only received 2023 proof will be exhibited, and that Asoong received the remainder can be shown.

So much as has here been related goes to the actual facts. --I now come to the evidence of crime on the part of DR. Caldwell, in controven- tion of these facts, to procure Shum Ahing's conviction of kidnapping. At the time wien Sham Ahing went to Macao with the 45 men, two ships lay there awaiting Coolies to proceed to Havana. One of these was The Ville de Lima The Fille de Lima, the other the Emilie Pereire. sailed on the 16th of January 1860, the Emilie Pereire on the 22nd --For nearly two months prior to the despatch of the Ville de Lima, the only ship for Havana from Macao was the Norway on the 25th of November. After her was the Emilie Pertire, and, then according to the Harbour Master's record, no other ship left with Coolees till the 12th February. The Coolees, then, being in Macan in December and Janary, in order to make out that they had been kidnapped and sold, it was necessary to show that they went in one or other of the ships then loading, cis the Fille de Lima or the Emilie Pereire. The latter vessel was selected, and it is interesting to note how careful the conspirators were not to reach Macao in search of the men until the day of her clearance, and when, if the Coolees had been on board, it would even then have been possible to release them.

Shum Aling's business being completed, he returned to Hongkong.on the 12th of January, and was almost directly visited by Asoong and Mal-chow Wong's wife's brother-And on the same day, siz the 12th, Asoong saw Caldwell, and told him how far the case had progressed. But it was desirable that the Emilie Percize should be away before the blow were struck, and as it was known that she would go before the Chinese New year, which fell on the 23d of January, it was necessary to delay a few days. That Shum Ahing should be on land it was then determined to arrest him for $173 due, or said to be due by him on account
