Of convicts who were sent home from China in the ship "Marchwick of Londonderry" in August last, and received into Millbank Convict Prison unaccompanied by the necessary Judge's Orders, a statement that there convicts cannot legally be held in custody unless some warrant for their detention is forthcoming.
As nothing was known there of these convicts at the Horse Guards, enquiry has been made through every channel, but without result, by Admiralty as will appear by the accompanying copies of the correspondence. And thereafter a letter has been addressed to the Officer Commanding the Troops in China, with a view to an enquiry and report being furnished as soon as possible.
It may be observed that Lt. Creyke, 67th Regt, who is alluded to in Lt. Col. Mackenzie's memo, disembarked in June last at the Cape of Good Hope, where he is still supposed to be.
The Admiralty was the only source where information could be obtained, the guard over the convicts being taken from the Royal Marines.
