At the request of the Lords of the Committee of
Privy Council for Trade, I have to call your attention to the 242nd section of
the Merchant Shipping Act of 1854, (clause 5).
That section prescribes the cases in which the Board
may
cancel
or suspend

of Trade or Mate's Certificate for misconduct,
and it distinctly provides that, in the case
by any

Court or

of any investigation made Tribunal authorized by the Legislative authority in
possession to enquire into the conduct of Masters and Mates, the report of the Court is to be confirmed by the Governor or

person administering government of possession.
I am led to advert to this subject from the circumstance, that in a recent instance the Board of Trade were unable to cancel Certificate in consequence of an omission on the part of a Governor to confirm the report of a Marine Court.
