Whether the proceedings taken, and the several steps of conviction, judgment, and Commitment, were regular in form and according to law, may of course be questioned thus
For these reasons, which I have thought it right fully to submit to Your Excellency's appreciation, I have felt justified as Her Majesty's Envoy Extraordinary and Minister Plenipotentiary in Japan, in calling upon you as the first Authority in the Colony where the Court is situated, to give me such legal Assistance as may be in Your power, and to place the case in the hands of the Attorney General, that Her Majesty's Government may be assured everything will be done in the matter, which can rightfully be done.
I am entitled to assume that they were (so far as I am concerned or responsible) legal until the contrary is proved, and to consider the action now brought as "vexatious". That its success, by reason of any want of efficient legal advice and service, would be a great injury to the Government and the Public interests they represent, since it must inevitably tend to embarrass if not to deter him altogether from the execution of his office, is beyond question.
Coming to the trial now to be undertaken, I believe a right to object to the trial in the Court selected by the Plaintiff is secured to me by law, and if so, I deem it for many reasons desirable to avail myself of this right, and remove it to the Court of some other Bench, such as the Queen's ...
