This exception it is at once grounded granted is a well, me and the framing of the clause in the manner in which it appears in the Ordinance in question the result of a mistake which arose this.
Was By Ordinance No 5 of 1858 the then Attorney General Mr Anstey extended to this colony many acts of Parliament some in their integrity so modified. Amongst others he adopted 21 Vict Cap 77 Sections 2, 3, 4 – 21 to 38 both inclusive.
This Ordinance was approved of at home without hesitation, but here it was found that it would not work at all so clumsy had been the arrangements made to adapt the several Imperial acts to this Colony. It was therefore found necessary to repeal the Ordinance wholly and pass separate Ordinances applying each particular Act.
