been placed in confinement, and warned

they would have been cautioned against saying anything

which would incriminate themselves; moreover the

fact of their being released from confinement and allowed to return to their duty, would in Military Law have condoned their Offence.

That the Prisoners having been sent out armed, and

ordered

assaulted to

capture their assailant
