It is further seen from the Accounts before us that from June to December 1859 all mention of Archer's Secena is omitted, and this omission in the Public Accounts of the five months preceding Mr. Gunthorpe's charge is not shown by the papers to have been the subject of enquiry during the investigation of the case, - neither do the queries of the Auditor General furnished to Mr. Gunthorpe with the Accounts shew that any question had been raised on this Examination of Mr. Newman's Accounts.
There is therefore nothing to shew that Mr. Newman Collected such fees, and if he did so, how the Public have had Credit for them : but at all events the irregularity which appears to have grown up before Mr. Gunthorpe took charge should have been checked, and directions should have been given before 1860, for crediting the Head of Emigration Broker's Secena fees in the Collector's Accounts with a "Mil" Return when there had been Receipts.
As the case now Comes before us we do not find that any answer has been given to Mr. Gunthorpe's assertion to the effect that this Branch of the business was under Mr. Newman's sole Control, and that the Emigration Broker's fees had always been paid over to Mr. Newman without being entered by him in his Monthly Returns of Public moneys, and without being paid into the Colonial Treasury ; but we are not furnished with the evidence on which the Legislative Council Came to opinions adverse to the truth of Mr. Gunthorpe's statements.
