As regards the case it is stated that, on 263 of Mr Hickern, inquiry at the Colonial Secretary's Office, it would became liable for the repayment of passage money, under paragraph 132 of the Colonial Regulation.

In reply to a query addressed to the Colonial Treasurer at Hong Kong, it is stated that such agreement was entered into by Mr Niblett, including the year's passage - salary only, as well as the advance of salary allowed to him on the understanding that he was to resign. The advance to cable if lost, therefore, Mr Niblett has been made to agree to the repayment of the amount made with him.

The agreement entered into with Mr Niblett has been transmitted to your Lordships. It is to be noticed that the agreement entered into with him, or, if entered into, that it was not transmitted to the Colony.

We have thought it proper to bring the subject under the notice of your Lordships, with a view to such steps being taken in the matter as your Lordships may think fit.
