Sheriff of this Colony, such as was open to him, but the right of the latter may well be questioned to demand that the man should be given up for trial before the Police Magistrate, and make it dependent on the decision of that functionary, whether he should be handed over to the Commander of the "Thbe" or be restored to the Vessel in which he came.

Having on previous occasions been repeatedly told by the Sitting Magistrate that the Court could not take cognizance of cases of desertion from foreign ships, which had not actually occurred within the Waters of this Colony, though the deserter was here at the time, I am unable to conceive how such a power should be vested in the Court in the present instance, where the crime had been committed in a foreign Port, and it strikes me forcibly that it would perhaps have been beyond the power of the Magistrate to do otherwise than deal with the case...
