Commander of the "Elbe" declined to

deliver the man, but was to send

him to the Police Court under escort at noon this day (8th instant). On

the 7th instant I received a note

from the Prussian Vice Consul (enclosed #2), by which it appeared that the man could not be brought to Court and, in consequence,

I wrote

to the Vice Consul mentioning what the Summoning Officer had

reported to me

regarding the intention of the Commander of the "Elbe". I further stated

that the steps taken

were, under the provisions of Ordinance 4 of 1880, made especially for Foreign Shipping,

and that as the seaman

had deserted from the American Ship in this Harbor, it was shown to the Court that the

man had previously deserted the "Arcona", and to this I received

an answer this morning (Enclosed No 3).

The United States' Consul

came to the Police Court this

morning, to ascertain the result of this application, and

I made him acquainted with the refusal of the Commander of the "Elbe" to deliver over the seaman, and

I further told him (the United States' Consul), that I should

report

the matter to His Excellency
