An application was accordingly made by the Magistrate to the Commander of the "Albe" for the delivery of the man, but the Officer declined to give him up, stating that he was a deserter from the Prussian Man of War "Arcona", and
that his name was Sulkofsky, of which there was evidence on board the "Albe". The Officer promised, however, to send the man to the Police Court under escort with evidence in support of his claim, – which claim he was informed by the magistrate would, if established, be held by
