I returned in consequence of a message. - Mcodd and Davis were two of my crew, - Davis was lying on his back in the Cabin, - his bowels were protruding. - Mr. Lever arrived at the same time that I did and examined the wound. - Dr. Simpson, for whom I sent, came afterwards. Davis died the following day at 5 in the evening.
The Prisoner was on board the Lady banning when I came on board. Next morning about 7 o'clock I saw the Prisoner on board the Lady banning. – I removed him to the Consul's Chop. - I asked him was he aware that the man was dying whom he had stabbed? He said "Yes, and serve him right". Davis was a very quiet Man, - Deceased complained of pain when I saw him; and the pain continued until about 6 hours before his death. - There was very little blood. I believe that Davis was quite sober.
Cross examined. – The Prisoner had been with me about 2 years and 6 Months, I never heard of his having quarrelled with deceased, I had no fault to find with the Prisoner on board.
