jurisdiction from the Prerogative Court of Canterbury to the new Court of Probate were adopted in their integrity, likewise the clauses empowering the Common Law Judges at Westminster to sit in the Court of Probate. Also all the clauses giving probate jurisdiction in certain cases to the County Courts and giving a right of appeal therefrom (only substituting the summary jurisdiction of the Supreme Court for the County Courts). Also all the Clauses respecting wills of real estate / all property in the Colony being personal (or held on terms of years).

It is therefore necessary to frame a new Ordinance specially for Probate and administration affairs, and in framing such, to modify the provisions of the act above mentioned. The Ordinance in question was framed with such a view - adopting all the previous provisions of the act above mentioned and also of the act 21&22 Vict. Cap. 95 to amend the act of 20&21 Vict. Cap. 77, which
