Next, if there be no claimant at the expiration of 3 months from the Return of warrant, the court on petition of the Rector and allegation that the warrant has been returned upwards of three months and no appearance entered, will decree a monition calling all persons to show cause why the property should not be condemned at the expiration of a year and a day from the date of Return "as Droits.
This monition is returnable in 3 months and is after proper service to be returned into the Registry with certificate of service. In the meanwhile the property will have been in the custody of the court, but if it be in bad condition and perishable, and the Judge be satisfied by Affidavit that it is for the general benefit that it be sold - it may be appraised and sold, and proceeds paid into the Registry.
