The Chief Justice being excluded, by colonial law from the Executive Council, the Attorney General is, as here stated, the officer next in rank who is eligible - I approve therefore of the vacant seat being conferred upon the Attorney General and sanction the temporary appointment

of Mr. Green (who is the acting Attorney General).

A warrant for this temporary appointment of Green is not required?

I entirely concur with Lord Wellesley in thinking that a man of principle is much more useful and often more compliant than one without it.

The Governor having reported in a despatch of 15 Dec that Mr Green has resigned the office of acting Attorney General, his appointment to the council was not confirmed.
