books, having apparently been manufactured to sustain the charges against Colonel Caine; and not having been produced at either of the former investigations when account books were called for, were ordered to be impounded. The Defendant next called the Prosecutor and subjected him to a thoroughly inquisitorial scrutiny of all his conduct relative to the charges of Extortion originally brought against his servants and the enquiries thereon and called upon him to swear under cath that he had not received sums or portions of sums of money mentioned as "duty money" in respect of the markets.

The Case was interrupted in consequence of the lateness of the hour, before he had concluded his Examination in chief of Lieutenant Colonel Caine. The Defendant then intimated that his examination of Colonel Caine was not nearly concluded, and that he had a dozen other witnesses to call.
