Mr Mercer quoted Despatch of His Excellency Sir John Bowring No 12 of 9th January 1856, in which the selection of a Barrister for Chief Magistracy was suggested in order to meet a contingency like the present, - and Mr. Mercer urged the advisability of adhering to the arrangement then proposed, and placing the Chief Magistrate on the Bench of the Supreme Court in place of Mr Hulme.

The Honorable The Lieutenant Governor voted for the motion, observing that the appointment of the Chief Magistrate to the Chief Justiceship would be a supersession of Mr Green, the Acting Attorney General; and he thought the higher officer in rank should be appointed.

"His Excellency The Governor voted with the Attorney General and the Lieutenant Governor, and the motion was carried.

"With regard to filling the vacancy in the Office of Acting Attorney General, which will occur in consequence, it was agreed that the appointment be deferred till the government be in possession of the
