Caldwell case which (us the only Lawyer in the Commission) Mr Davies ought to have kept in some order, and his want of discretion exhibited in the Legislative Council, - of which some evidence went home in my Despatch N.G dated 24th April 1917.

Janing last, to satisfy me that I should be justified in placing the supreme functions of Judicature in Mr Davies' hands, - though I have suggested, without however any personal reference to Mr Davies and long before his appointment, in my despatch No. 276 of 9th January 1808, that such a course might be desirable I earnestly hope the next mails from England may relieve me from existing embarrassments. If not, I think it will be best that my Successor should decide on the measures to be adopted, especially as I have reason to believe a difference of opinion exists on the subject among the Members of the Executive Council.

The Mail from London of 25th January is looked for hourly and the other of 9th February in a fortnight from this date.
