3. Nevertheless there are portions of this Ordinance of which it is impossible to advise Her Majesty to approve, and which it is hoped may be safely dispensed with by the time when my present Despatch reaches you.

I would particularly instance Art:11, which seems to expose the lives of peaceful inhabitants to serious danger without adequate cause; Dec 14, which authorizes not only persons in the sea and land forces serving Her Majesty, but also officers of Her Majesty's Allies, to exercise the same powers as they would have had if Martial Law had prevailed in the Colony, and which (together with sections 13 and 16) tend to seem an abuse of the powers of this Ordinance, however excessive.
5. I have not thought proper to advise the disallowance of this Ordinance, considering the circumstances under which it was passed. But I have to instruct you to put in force the powers vested in you by Sec: 1 by suspending its operation, and not to bring it into effect again without permission previously sought and obtained from Her Majesty's Government.
6. The power given to the local Government by section 7 for the removal of dangerous persons, may be rendered permanent with advantage to the Community, considering the danger to which you are exposed by the immigration of foreigners of...
