3. Nevertheless, there are portions of this Ordinance of which it is impossible to advise Her Majesty to affirm, and which it is hoped may be safely dispensed with by the time when my present Despatch reaches you.

I would particularly call your attention to Art. 11, which seems to expose the lives of peaceful inhabitants to serious danger without adequate cause; and to Sec. 14, which authorizes not only persons serving in the sea and land forces of Her Majesty, but also Her Majesty's officers, to exercise the same powers they would have had if Martial Law had prevailed in the Colony, and which (together with sections 13 and 16) tends to exempt the powers conferred by this Ordinance, however excessive, from the cognizance of the regular tribunals.
