notified; the Bench by (enclosure A), that
MAS
coming
on
a certain case
for trial under
Ordinance No 8 of 1856.
The circular was seen and subscribed by two members
of the Bench, the second of whom, it appears, forwarded it to the Colonial Secretary, who withdrew it from circulation and returned it to the Casting Chief Magistrate. Upon the fact becoming known to the Justices generally a general meeting of the Bench was called for the purpose of taking the
matter into consideration, and
were appointed a committee
to address the Government in the
name
of
the Bench for the purpose
of ascertaining
the
reason
why
the circular has been intercepted.
We accordingly, on
the 12 instant,
wrote to the Colonial Secretary
(enclosure B), requesting that he would state to us, for the information of the Bench, the reasons for which
the course taken with the circular was adopted by the Government, and received from him on
the 3rd instant a letter in reply, (enclosure C), in which he stated that he had not intercepted the circular, stating that it must be well known to us by whom the circular was stopped, and referring us to the party indicated for an explanation of his reasons.
On the 6th instant we again wrote
to the Colonial Secretary (enclosure D), pointing
out to him that as it was
he who returned the circular officially to the Magistrate,
we must still consider that it was he who stopped it, and respectfully requesting that he would furnish us with the information previously asked for.
