Land in the Colony is also a matter of concern. But it is clear that the requisition of such Land by any other person than the owner of the Marine Lot behind it would diminish the value of the Marine Lot, and in many cases render it useless for the purpose for which it was acquired. It appears in this case, therefore, that while the interests of the town and the interests of the public require that the claim of the Crown to such Lands should be properly maintained - a sense of Justice requires that the equitable claims of the holders of the Marine Lot should be liberally considered.

4. The most practicable way of reconciling these interests, it seems to us, would be to appoint an arbitrator on behalf of the Crown and the Proprietor of the Marine Lot, or if it be preferred, a jury to assess the damage done to the original Marine Lot.
