(cited in the Act against Passenger ships) to obtain before sailing the certificate of an Emigrant Officer that they have complied with certain Regulations annexed to the Act, and to submit to them, if British or within British Jurisdiction, to examination by the commander of any of St. H.M. Ships or by any Naval or Emigration officer.
Or British passenger ships liable to forfeiture when not furnished with Regs. papers and subjecting the master to penalties when the Regulations of the Act have not been complied with. This renders it necessary therefore to consider the Instructions which should be given to
Commanders of H.M. Ships for the execution of this Act.
The Act contemplates the interference of Officers of H.M. Ships (1) when they meet themselves "Passenger ship" within British jurisdiction and (2) in the case of such a ship being a British ship on the high seas.
In the first case the ship might be British or Foreign, but if Foreign it would be necessary to bring it within the operation of the Act, that she should have sailed from a Port in the Colony. Such a ship found within British Jurisdiction would be equally liable to search
