I have resolved to lay the matter before you, and request the advice of the Law Officers of the Crown.

The Statement to which Mr. Anstey refers has not been received, as on the 30th Ultimo Mr. Auster sailed on month's leave of absence on Sick Certificate.

I may add that the case Mitchell v. Anstey alluded to in the correspondence resulted in a verdict for the defendant.
