with respect to one of the Lots, Marine Lot No 1060, which, from the accumulation of the soil, lies seaward of another Marine Lot, sold many years ago, and Mr. Harper, the mover of this latter lot, as also the purchaser of Lot (the Enclosure) No 106, similarly situated in the 115, have protested against the Sale of ground Seaward of his Marine Lot.

The question, if rendered one of difficulty, can be settled by the resumption of the old Marine Lot, for it is impossible to permit a great public improvement, like that effected by the Sale of these two Marine Lots 105 and 106, to be defeated by the opposition of one individual.
