Mr. Turner and Captain Bathurst, I do not know that any evidence upon Mr. Mitchell's demeanour has been heard by his Excellency. With reference to the evidence of Capt. Bathurst, that Mr. Mitchell indulged himself with "unseemly language and self-assertion", I have only to say, that from the position of Capt. Bathurst occupied upon the Bench, it was impossible for him to observe the countenance of Mr. Mitchell when he spoke to me. And therefore it is not likely that he could judge correctly of his demeanour or expression.
I charge Mr. Mitchell with having grossly, in language, demeanour, and conduct, insulted me while in the performance of my duty as Her Majesty's Consul, thrown contumely upon My Government; and in the name of the Government of the United States, I request at the hands of the Government of this Colony, the dismissal of that Magistrate, or a satisfactory apology for him.
