The defendant being an American Citizen, it is usual, as a matter of courtesy, to offer the Consul a seat on the Bench. Mr. Mitchell then addressed Mr. Munson in most contemptuous manner, saying the following words:
That such was the custom, but that on former occasions Mr. Munson had grossly insulted the Court in a most disgraceful way, and that no courtesy should be extended to him, and that he would not offer him a seat on the Bench.
I then said to Mr. Munson: "You have been so insulted, you must leave the Court." Mr. Munson, however, asked Mr. Mitchell if he spoke on his own responsibility or whether he was following the instructions of a Superior Authority.
Mr. Mitchell declined giving any reply. The Counsel then protested against the action of the Court in the matter. The Magistrate replied that he paid no attention to the protest further than to file it.
