he thought that, in such a case, a fair and equitable compensation, and not merely such as the Surveyor-General might think to be just, right to be granted. The present Governor admitted that, by giving me what I asked, after, he had refused what he offered. That was the case of Marine Lot 73.
13. The entire Lot had been resumed for the purpose of a battery previously constructed on it. I had refused the cost price (180 Dollars) which they offered me, and they gave in lieu of compensation two Inland Lots on the opposite side of Queen's Road, which I had applied for and signified my readiness to take in exchange. It was a most advantageous arrangement for me. The extent of land resumed was about 80 feet on the fourth. The quantity given me in exchange was about 3 times as much. It has never been measured.
With respect to the reclaimed land, I have been several times in the room about the point of title. Ponce saw Sir George Bonham about it. I had just bought Marine Lot Wayo, and was filling the space between high and low water mark. He said that he could give me no lease, but that he would not interfere unless my neighbors complained; and that, as to ulterior measures of Government, I must take them upon my own responsibility.
