Mr Leslie, to whose remarks the Chief Justice refers, states that he communicated to Mr Mitchell the substance of the charge, at an interview which he had requested last Saturday for the purpose of supplying the information which Mr Mitchell is now suing me (for stating to Mr Leslie, that Mr Caine, the Superintendent of Police, had made the late charge against Mr Mitchell, and which was even then pending before your Excellency.) 1. Mr Leslie also states that he does not remember repeating it to any one else.

It is not difficult to understand why it has been carried to the Judge who will preside at the trial of this action in which Mr Mitchell, a late writer in Messrs O'Reilly's 'Hongan Register', is the plaintiff; and the same person, in all likelihood, may preside at a criminal trial in which the respect of the late proceedings at the Gaol, is likely to be the defendant.
