11. That the said Emigrants shall be treated with kindness by the Master, and all Officers and the Crew of the said Ship; and that the Master shall on all occasions, when practicable, attend to any suggestion of the Surgeon calculated to promote the health, comfort, or well-being of the Emigrants; and further, that the Emigrants shall on no occasion be called on to do any manner of work on board the vessel other than cleansing the between decks, or receiving at the hatchways in the between-decks fresh water, and provisions and fuel; and that on the occasions of cleaning the between-decks they shall on no account be placed to draw water from the sea on the gunwale, in the chains, or in any situation which shall endanger their falling overboard.

12. That the Master shall strictly prohibit, on part of the Crew or Officers, the sale of spirituous or fermented liquors, or of opium, to the Emigrants during the voyage.

13. That the said Emigration Agent shall have every facility for the inspection of the ship, and of all her fitments, provisions, water, and stores, but that his approval thereof shall not in any degree lessen the responsibility of the owners of the said ship, or the said Party hereto of the second part.

14. That the Ship, if required for the health of the Emigrants, shall touch at the Cape of Good Hope or St. Helena, for the purpose of obtaining Water, Fresh Meat, and Vegetables, but shall on no account break "bulk" before arriving in the West Indies.

15. And it is mutually agreed by the parties hereto, that twenty-five clear working-days, commencing at noon of the day in which, under the present Contract or any renewal thereof the said ship ought to be ready for the reception of Passengers, shall be allowed as lay-days for the embarkation of such Passengers, and that ten clear working-days shall be allowed for their disembarkation in the West Indies; and that if either of the parties hereto of the first or second parts shall detain the vessel beyond those periods respectively, unless at the request or with the consent of the other party signified in writing, the party so detaining her shall forfeit to the other ten pounds sterling for each day of such detention, except the same shall arise from wind and weather; and that such penalty shall be deducted from the passage-money, if payable by the party of the second part.

16. That in case it shall be necessary to place in Quarantine the Emigrants, after arrival in the West Indies, they shall not, on that account, be entitled to the use of the ship, nor shall the said party of the second part be liable to maintain them for any longer period than ten days as above agreed upon.

17. That Passage Money shall be paid at the rate of ... per statute adult for the full complement which the Ship would be legally qualified to carry from Calcutta to the West Indies as such complement shall be certified by the Government Emigration Officer at Hong Kong, subject, nevertheless, to a deduction at the same rate for every Emigrant who shall die or leave the Ship during the voyage.

For the purposes of the present Agreement, the term statute adult shall signify one Passenger above the age of ten years, or two Passengers between the ages of one and ten; and no payment or deduction shall be made for children less than one year old.

18. And the said party of the first part hereby engages that the Passage Money found due as aforesaid shall be paid by the said party of the first part, within thirty days after there shall have been deposited with the said Commissioners the four following documents:

1st. An account signed by the party of the second part, stating the particulars of the claim.

2nd. A Schedule signed by the said Emigration Agent of the Emigrants embarked by him; distinguishing between Males and Females, and between adults above the age of ten and children under that age, and specifying which of such children are infants less than one year old.

3rd. A Certificate, signed by the Government Emigration Agent, at the port of disembarkation, stating the number of such adults, children, and infants respectively, landed alive, and that he is satisfied that the terms of this Charter Party have been fully and fairly complied with.

4th. A Certificate, signed by the Surgeon, declaring that the Emigrants were treated according to agreement during the voyage, and specifying the names and ages of all who have died or left the ship during the voyage, and if none have so died or left the ship, containing a declaration to that effect.

19. That for the purposes of this Agreement, the term Emigration Agent shall include any person appointed by the Emigration Agent, or in his absence, by the Officer administering the Government of Hong Kong, to discharge his functions.

20. Provided also, That the said Commissioners, or their Secretary, or the Government Emigration Agent at the port of embarkation shall not be personally liable, nor shall their private estate and effects be responsible for the payment of any money or damages that shall or may become due or recoverable by virtue of these presents.
