6. When you, as Superintendent of Police, went on board the "Carleton" did Captain McCluney state that he "protested and refused to surrender"?
When I went on board the United States Steam Frigate "Carleton" I saw Captain McCluney. I said that I came on board expecting to find there the United States Consul and the Master of the "Reindeer". Capt. McCluney answered that they had been on board but were not at that time. I thereupon requested permission to state to him the particulars of the case of Madison, and proceeded to do so. I did not make any demand for the surrender of Mr. Stickney, and consequently had no answer. Mr. Elmay did not state that he would give him protection. At the conclusion of my representation of the case I suggested that Capt. McCluney should use his influence to cause the payment of the fine, which would obviate any further unpleasant feeling.
7. Was Capt. McCluney arrested?
Capt. McCluney was summoned in the usual way for the assault upon "Madison", and duly attended accompanied by the United States Consul.
