This case differs, as already stated, in this way from others of a similar nature, and also that the United States Consul has, on various occasions, represented himself satisfied with the assistance received from the public officers of this Colony, and how at no time referred any official complaint against the Executive or Magisterial portion of the Government.

Your Excellency further remarks that Captain Michie was fined for an Assault committed when he was not on board his ship. In reply, I must point out that the depositions formed, and on the testimony of the Captain's own witnesses, that the assault complained of was committed by the Captain himself. As regards the apprehension and delivery of Madison, I must inform Your Excellency that, at the request of Mr. Consul Keenan, every lawful endeavour has been already used to effect this object. The man was apprehended and brought before a Magistrate, to whom he gave sufficient reason for his discharge from custody; as it appears from the depositions, he swore that "his life would be endangered if forced to return to the 'Reindeer'".

This step and decision were in strict accordance with Sect. 7 of our Ordinance No. 4 of 1850, an Ordinance which, and I beg Your Excellency particularly to note this, was passed at the special request of Mr. Buch, then Consul for the United States at this port.
