Men Maddison came off. I felt my own responsibility as deserter. Next morning, he was told to turn to, but he said he would not if he could. When the Captain came in, Maddison struck at him and I caught hold of him to put him in irons. Violence was used to him. I then threw him down and used him pretty roughly (he struck me in the breast). The blow in the eye was given by the edge of the hatch as I threw him down. The Captain did not strike him at all. Maddison, when he refused to turn-to, said he would kill the first man who laid hands on him. He was kept under the break of the poop, and the Steward gave him plenty to eat besides his water and biscuit. I whipped him with a chest lashing, but this was before he was put in irons. I can't recollect whether defendant struck the man or not. I did not see him have a cudgel, but I did not see it.

Defendant declines to make any statement.

Hearing adjourned until Thursday next, at the request of plaintiff by his Attorney, M. Strace.
