LIBELLOUS STATEMENT The statement that they have absconded." -submitted Counsel, “I not true. is a libellous statement. A statement of this kind in the Official Receiver's report is pri- vileged."
It was denied by Mr. Mac- namara that the four were the directors and that they had absconded. On the point of con- sent, this Company was a private company. and before his clients could become the directors, they had to consent. but none of them ever consented to act as a direc- tor. It was true that all these four gentlemen were the directors of the China State Bank, which

Reverting to the question of absconding. Mr. Macnamara sub- mitted that the first three of the directors live in Shanghai, and the other one lives in Canton: this fact appears from the "Com- pany's fles. Some sort of false information must have been cir-
culated, and this induced the Offcial Receiver to sign the report which he did.
Mr. L. R. Andrewes the Official Receiver, informed his Lordship that the information emanated from Mr. Chen Shak-ping, a director of the Company and assistant manager, and Mr. Wong Lam-hing, the general manager of the bank. Mr. Prentis, the then Official Receiver, had no oppor- tunity of confirming the statement because of the fact that th's Company was a private one and he had no records.
Formal application was then mate by Mr. Andrewes to bla Lordship, when he also added that that no notice of opposition had been received
