Europeans In Court

Miss Barbara Lord, of the St. George's Riding School, Kowloon City, was summoned before Mr. K. M. A. Barnett at the Kowloon Ma- gistracy yesterday for the posses- sion of a .38 calibre. automatic pistol and one magazine without a Ucence from the Hon. Inspector General of Police..>

Detective-Sergt. D. G. MacPher- son said that on October 31 while he was conducting enquiries at the St. George's School, Miss Lord. produced the pistol and asked him whether or not she required a 1- cence. He instructed defendant to keep the pistol till the next day during which he would make en- quiries. On the following day a summons was issued.

The facts of the case, as out- lined by Inspector O'Donovan, were that early in 1932, complain- ant was a shop-keeper in Amoy. Defendant was a commission agent in the sense that he sold wares for merchants and received a com-ing to Chan Tam-iin, tailor.

Evidence was also given by a dis- also

Wah Kerosene Oil Co. of Macao. At the end of February he went to Macno where the defendant was introduced to him. In the course of a conversation Sousa mentioned to complainant that he knew a man named Elliott" who could pro- duce kerosene from water. Com- plainant was interested and de- fendant suggested they should go to Canton. There Sousa took com- plainant to Shameen where he met Elliott in the latter's house. Complainant would say than an experiment, involving a lot of ap-. paratus, was conducted by the two, at the end of which e, complain- ant. was satisfied that kerosene oil had actually been produced from water.

A CONTRACT Defendant now suggested that they should go to Hong Kong and start this business. They tanie here about the first week in March and put up at the Tung Shan Hotel complainant paying the cost.. Whilst there defendant produced a contract, the gist of which was that Ellott, was to receive $500, de- fendant $300 and complainant $500 as manager. All three signed this contract. It WELS further the capital of the agreed that company was to be $10,000, which money was to be put up by com- plainant, and that the profits were to be divided fifty-fifty.

About March 13 mlott asked for an advance of money and com- planiant gave him $500. Defen- dant asked for $125, this to be deducted from his salary, and the complainant also gave this. They stayed in Hong Kong (or some time and then all three went to Amoy, where complainant was taken to the Naval Dockyard and purchased four large bollers, paying $3,000 for them. A site was selected and the bollers erected.

MORE CHEMICALS Souza now suggested to com- plainant that they should go to Hong Kong and buy more chemi- cals for the manufacture of the kerosene oll. In Hong Kong they again stayed at the Tung Shan Hotel and here complainant paid over various small sums to Souza, totaling $180. Actually the money was alleged to have been advanced to defendant by a third man, a Idead of the complainant's. Near the end of March they went back to Canton and stayed at the Tal Tung Hotel EiLott got 20 largé bottles of liquid and said the cost was $8,000, Elliott took complain- German firm from ant to the which they were supposed to have been bought. Complainant waited in an outside room and Elliott wept into an inner room with the $8,000 which complainant had handed him. He came out a little later and said the money had been pald over. The bottles were taken away to the Customs House and Sousa told complainant arrange- ments had been made for them to be shipped to Amoy.

WENT TO AMOY

He also stated that deceased and Wong Lap were each taken into the detective's room ance, and he saw both beaten by a police officer whom he recognis- ed as Kwok Kum (C152) and de- tective No. 454.

Mr. Whyntt: Does it strike you that Wong said he was not struck at all when he was in the detective room?-He was deceiving himself. How many times did you see Wong being struck?--I don't exact- ly remember how many, at least two or three times

DETECTIVE'S EVIDENCE Chan Chun, called to give evi- dence. stated that four persons in- cluding deceased and Wong Lap were brought in the station on August 31 and witness had been Instructed to take charge of the case.

In the course of investigations. witness said that deceased had re- lated to him a story which in- dicated that deceased had been assaulted to give false evidence in the police station accusing Wong Lap of having stolen the sewing machine. The assault occurred at No. 300, Castle Peak Road. Wit- ness informed district watchman No. 38 that the case was a "frame- | up."

Witness continued that he ob- tained permission from Inspector Hynes to release the two alleged suspects. The parties then left the station and witness personally saw deceased leave in the direction of Yum Chow Street.

About twenty minutes later wit- ness happened to go out of the station and he saw a person alt- ting on the pavement with his head leaning on
