Medical Evideu e

GUNNER'S TRIAL

Medical evidence was given by Dr. R. S. Begble yesterday at the Central Magistracy before Mr. W. Schofield" in the case in which Peter Macintosh, Gunner of the 7th Anu-Aircraft Battery. Royal Artillery, was charged with the manslaughter of Gunnier David William Berswick, aged 21, at Lye- mun Barracks on September 20.. It was alleged that the "accused struck the deceased a few blowS which resulted in his death.

Begble, medlcal officer in charge of the Victoria Mortuary. testided that he conducted a post- mortem. Witness stated that de- ceused had a mark on the upper portion of the lower lip. That could have been probably caused by a blow of a fist which knocked the lip against the teeth. The other external abrasion was found

on the left inner side of the elbow. and might have been caused by

Celebrates

China's National Day or the Double Tenth Festival, marking the 26th anniversary of the Chinese Republic, will again be cele- fall. On internal examination wit-brated by the Chinese communities to-morrow, not only in the ness found the heart in a very healthy, condition, as were all the other vital organs.

The deceased's Thymus gland weighed 30 grams. The gland of a normal person of deceased's age should be. in weight, 15 to 20 grams. Witness further sald that a person in normal condition could not have

such an enlarged gland and persons suffering from this are liable to die from heart fallure due to shock. In his opinion death was caused by shock. following heart failure which might have been caused by a blow.

'Cross-examined by Mr. Prior, for the defence, witness sald that cases of this nature were not common and occurred once in every thou- sand. In this case witress said tat although the deceased had had a boxing career, death might have been caused by one of the blows before, but the reason that he did not die while boxing was because he was prepared and alert. while on this occasion he was not.

DEFENDANT TESTIFIES The defendant, in evidence, said that he agreed with the facts of the case. Replying to Ms. Whyatt, the defendant stated that he struck the deceased because, he was an. gered by the language that he (deceased) used in the room.

3.

In view of the critical situation in China to-day, and the brutality of the Japanese aggressors in in- discriminately bombing the de- fenceless non-combatants of the Capital and other cities" of the country, it is doubtful whether the Chinese will celebrate the Double Tenth Festival this year with the enthusiasm of previous years.

The Sino-Japanese war has cast a gloom over what would have been an enjoyable occasion, and it has

the been suggested that money to be spent in celebrating the anniversary should be used for the relief of the wounded soldiers and war refugees in North China.

Major «G. M., Churcher, 7th A.A. Battery Commander, testifled that he had known the defendant since his arrival last year. The defen- dant to his knowledge was normal. quiet, and a sportsman possessing the average soldier's tempera- ments. The deceased Was ra-
