SPANISH BONDS IN LONDON

lean. each: claimed to be chieftain of Ardgour. The per- son, who bore the undifferenced

arns was the "head" or "chief" of the armigerous family. "Chief" in the law of arms simply meant head or principal of an armigerous family. Had chiefship of a clan or chieftainship of a branch of a clan, apart from headship of an arm gerous family, any significancë in the law of arms?

There was no evidence of any practice that would point to the use of “ chief of clan "or "chieftain of branch of clan" as correct heraldic descriptions of headship of an armigerous family. "

To stand in the succession of an ancient line of chiefs or chieftains might be a legitimate ground of. family pride, but it was not, a status that the law recognized.

The defence was that, according to Spanish law, the receipt of the sole executor was not sufficient, and that the bank would have to communicate with all the heirs of the deceased. Some of these were at present fighting, on one side or the other, in Spain, and it was im- possible to get hold of them. There was no doubt that the plaintin who was over 70 years of age, was entitled to the income from ano bonds, which had been transferred from the Paris branch to the Lon- don branch on the terms that they should be dealt with only on Instructions from the head, office in Bilbao..

Mr. Raymond Evershed, K.C., for the Bank of Bilbao, said that the bank had no personal interest in the bonds and were prepared to do as his Lordship arrected. They had no intention of breaking the order made last October.

The motion seemed to have been Inspired by the attempt of the Basque Government to supersede the managers of the London branch of the bank. That attempt failed as the result of proceedings In the King's Bench División “and, in view of the recent military events in Spain, it was not likely to be repeated in the near future. Mr. Justice Luxmoore said that no aspersions were cast on those managing the bank. He would make an order that the bonds in question should be lodged in court to the credit of the action, together with the £8,824 proceeds of sale of the bonds in the hands of the defendants. The fund would then be invested in War Loan.
