When you got to the deceased's house was the door open?--Natur- ally it must be open before I could get in.
How was the door open?—I can't say because I was the first person to enter.
Having got inside what happen- ed-First accused asked the aunt for money. Deceased replled that she had no money after which we (the three defendants) went into a room, only to be followed by de- ceaseti. When we were inside the room third accused sald to first ac- cused "If your aunt refused to lend you money, we must lay hands on her."
First accused sald "she brought me up when I was young and I can't bear to tie her up." I then walked outside the room; whether she was tied up or not. I can't say. After I had left the room, first and third accused came out about five minutes afterwards. Third, accused said that the aunt had, bitten her hand and asked me to keep watch over deceased,

There was nothing of that sort alleged by the Crown. It was fact that the death of the old woman was not intended. It was proved that the three accused went there with full intention to commit à robbery.
