The Master of the Rolls (Lord | THE Wright), delivering judgment, said it was clear that Major Rowland- son deliberately killed himself to
surance money. In regard to the allow his estate to collect the in-
cross-appeal, it was, at Mrs. Beres- ford's request, not proceeded with. but was adjourned until the pre- sent appeal had been decided.
On, the main question. Mr.Jus- tice Swift had decided that, what- ever considerations of public policy might be urged, the insurance policy constituted a contract that must be fulfilled.
As regarded the construction of the policy, continued the Master of the Rolls, however absolute in its terms a policy might be, the Court would not enforce it if it was illegal or against public policy: "The Court will not force the Company to pay a sum of money under a contract which involves the com- mission of murder," said his lord- ship.
