Barrister Admits Theft Of Large Sum Of Money

MR. ELDON POTTER, K.C. MAKES PLEA

FOR LENIENCY

In an attempt to rob his employer of $350, Pau Kau planned an unsuccessful coup last Friday in which he alleged that an assallant stabbed him and ran off with the money. He made an appearance before Mr. W. Schofield at the Central Magistracy yesterday on charges of larceny and making a false report.

Mr. Eldon Potter, K. C., the employer of the defendant ap- peared in Court, and Inspector A. E. Carey prosecuted,

his Inspector Carey Informed Worship that defendant was an office attendant of Mr. Potter's and at 11.20 a.m., on January 29 he was given a cheque of $350 to casti. together with a slip of paper on which were written the denominations which he was to get from the Hong Kong and Shanghai Bank in exchange.

At 1215 p.m.. defendant found in the lavatory of Prince's Building on the second floor, with his face downwards on the floor. by another office assistant who plcked him up and escorted him to the office.

THREE WOUNDS There were three small wounds on his left shoulder, and two on his thigb, and a pocket knife was found about two yards away. The blood-stained knife was produced in Court).

A doctor was called in who at- tended to him. and then the police were colled. Defendant made a report to him that he had been pushed into the lavatory, stabbed and robbed. Defendant was then taken to the Government Civil Hospital where he remained until Monday.

ALLEGED CONFESSION

In Pau's pocket book were found two $10 bills. After he was question- ed Pau confessed to inflicting the wounds on himself, and admitted that the money could be found in a cupboard in the hallway on the second floor of Prince's Building. At that place $330 was found in a roll of bis and defendant fur- ther admitted that the $20 in his possession was part of the loot.

Inspector Carey concluded that he was Instructed that in this case he was unable to urge a plea for leniency. The plan was deliberate and well thought up, but he would leave the matter in the Magia- trate's hands.

MR. POTTER'S PLEA Mr. Potter pleaded with his Worship to temper justice with mercy, adding that defendant had been in his employ for fifteen years, and first came to him as a small child and assumed his pre- sent position after the former office boy left,

Defendant' had drawn money out of the bank for him on in- numerable occasions and he had not found that one penny was missing in all those years.

Since defendant's arrest. it was learned that he was supporting a large number of people dependant on him: His mother, two "unem- ployed brothers, a wife. and two children, and it seemed that he had reached the breaking point and went wrong.

Passer-By Joins Chase After Snatcher

A young woman, Ng Fuk-min was walking along Luard Road at 9.15 pm, on Tuesday, when Ho Yee, 23-year-old unemployed; snatched her handbag and ran to wards Jaffe Road.

A passer-by, Chan Hon, folibed in the chase after the woman had shouted "snatching!" Ho eventual ly fell and a Chinese detective ap- prehended him.

The bag was found in his jersey and nothing was missing, but the strap from the bag was broken off when it was snatched from the woman's hands.

NO DISCREDITABLE REASON Appellant's counsel pointed out that a man might be dismissed for many reasons, good or bad, or over mere caprice on the part of his employer, and endted that the words in the case concerned im-

Counsel: Once the fact of dis- missal is brought to mind, the learned judge should have directed himself that these words were not capable of a defamatory meaning becatise no innuendo had been pleaded He should have stopped the case and mu let it go to the jury.

After the Hon. Mr. d'Almada e Castro had concluded, the Chier Justice said: "It is most regret- table that the respondent is unable to be represented here in Court. It is a simple but interesting climax to a case. It will take time to consider our decision and to put it into writing."
